Consent and Release Form

Dear Property Owner:

If you currently own a property that you think may be a “Brownfield,” please consider submitting your property to be listed on the Delaware Brownfields Marketplace. This “listing” service is free of charge. The potential benefits of a listed property include:

  • Attract the attention of interested developers – Developers may be looking to purchase, clean up, and redevelop a property such as yours for a variety of reasons, including the availability of significant incentives provided by State and federal government. There is also a new focus on revitalization by many municipalities, as they implement Smart Growth and Livable Delaware principles. Numerous developers and property owners have already participated in profitable partnerships, thanks to the Delaware Brownfields Development Program.


  • Listed properties may be eligible for State and federal Brownfields incentives - DNREC’s Brownfields Development Program can help prospective purchasers redevelop your property and as needed, clean up your property. Listing properties on the Brownfields Marketplace can be an integral part of this process. Although landowners, developers and municipalities may have different perspectives, many of our goals are the same (i.e., to redevelop or reuse underutilized properties and quickly return them to productive use).

Some property owners may be hesitant to list their properties on the Brownfields Marketplace because of liability concerns or fear of a stigma associated with the term “Brownfields.” Merely listing a property on the Brownfields Marketplace does not create landowner liability to the State. Moreover, there is a clear benefit for having former industrial or commercial property listed on the Brownfields Marketplace, as it targets developers who have successfully developed these types of properties in the past. Listing on the Brownfields Marketplace can increase the potential marketability of your property and expedite the selling process.

Recognizing the many benefits in having your property posted on the Brownfields Marketplace, we hope that you will agree to sign a “Consent and Release” form. You will be notified when your property is listed, so you may check the information.
